By registering to use the Read Listen Learn Service including all articles, recordings and other software tools and features ("Service"), you agree to be bound by these terms and conditions ("Terms of Use").
The Service is provided by ReadListenLearn Ltd ("Company"), a company registered in England and Wales, and includes the articles, recordings and related resources provided by the application and accessed via the login system.
The Company reserves the right make changes to these Terms of Use at any time without notice but will always endeavour to provide such notice via its website.
The Service is not intended for use by people under the age of 13 and anyone of that age or younger should not register to use it. Anyone between the age of 13 and 18 wishing to register to use the service should only do so with the permission of a parent or legal guardian or under the guidance of a parent, legal guardian, school, legal entity or teacher that has entered into a commercial contract with the Company whereby they take responsibility for the people to whom they distribute access to the Service.
In such cases the parent, legal guardian or school, legal entity or teacher hereby agrees that the person for whom they are taking responsbility is bound by these Terms of Use and fully indemnifies and holds the Company harmless should that person breach these Terms of Use.
Subject to your ongoing compliance with the Terms of Use, the company grants you a personal, non-exclusive, non-sublicensable, non-transfereable license to use the Service.
You acknowledge that all Read Listen Learn articles and recordings are the intellectual property of the Company (with the exception of those elements thereof that have been licensed from third parties) and that you can only use them in accordance with these Terms of Use. You further acknowledge that:
In the case of elements of articles that have been licensed from 3rd parties, including those available under Creative Commons licenses, you hereby agree to comply with the terms of those licenses when using articles that include them.
You agree that you will not use the Service for any illegal purpose or to violate any laws in your jurisdiction.
You agree that you are responsible for all content that you post using the Service and for all your activity when using the Service and that you will not post any content or submit any material that is illegal, obscene, threatening, harassing, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise damaging to third parties. You understand that this condition applies to any content that you post using the Service, whether to the Service itself or to third parties such as Facebook and Twitter.
You agree that you will not attempt to hack, violate, circumvent, reverse-engineer, decompile, disassemble, or otherwise tamper with the Service and that you will not use it to transmit computer viruses, worms, defects, Trojan Horses or other items of a destructive nature and that you will not permit others to use your access to the Service to do so.
You understand that the Company will have to suspend or remove your access to the Service if we become aware or suspect that any of these conditions are being or have been breached.
The Company reserves the right to modify or discontinue the Service at any time, either temporarily or permanently and is under no obligation to give notice before doing so.
Continued use of the Service after any changes made to it shall constitute your consent to such changes.
The Service may include links to third party websites and/or applications and content from third party websites and/or applications might be incorporated within the Service. The Company is not responsbile for such content and cannot guarantee to have checked it for accuracy or to have otherwise verified it.
The Service is only available for use by people who have registered with us and have a valid subscription.
People can register to use the Service as individuals free of charge whereby they are given access to a subset of our content and a subset of the features of the Service. People can also pay for the Service whereby they get access to all of the published content and other features that we have released at the time of purchase.
Details of these services and our pricing is published on our website from time to time and we reserve the right to change it at any time in the future, possibly under revised Terms of Use. Existing customers will not be affected by any change in price for the duration of their subscription unless they upgrade their account.
You can contact us to change your subscription at any time. If you choose to add more members to your school, we will increase your subcsription and charge you pro-rata for the additional members for remainder of the current period. If you choose to reduce the number of members in your school, we will action the change at the end of the current subscription period and alter your payments from that date onwards.
You can cancel your account at any time.
If you are using the Service under the guidance of a teacher, parent, legal guardian, school or legal entity and you wish to stop using the Service you should consult with them about doing so.
If you have a Free account then your account will be cancelled within 48 hours of your request.
If you have a Premium account you will be moved to a free plan at the end of the current prepaid billing period.
If you are the owner of a School you will also be moved to a free plan at the end of the current prepaid billing period. Accounts for individuals who are enrolled with your school on Read Listen Learn will be converted to free accounts unless the individuals themselves request that their accounts be cancelled.
In the case of both free and paid accounts, we will keep your data for a period of 60 days before deleting it in case you decide that you wish to reinstate your account or access a copy of your data.
The Company can terminate your use of the Service at any time if it believes that you have failed to comply with the Terms of Use at its sole discretion and without having to provide a reason for doing so.
The company can discontinue any beta programme that it may be running at any time and is under no obligation to provide prior notice of doing so.
The Service is provided on an 'as is' and 'as available' basis.
The Company does not warrant that:
You agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from your use of the Service or your inability to use it.
You agree that The Company will provide technical support by email or other electronic messaging system only and will endeavour to respond to all queries and resolve problems and errors that people might encounter but does not guarantee to do so.
The failure of the Company to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
If any term or condition of these Terms of Use is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable from the rest and will not affect the validity and enforceability of any remaining terms or conditions.
The Terms of Use in force at the present time constitutes the entire agreement between you and the Company and supercede any previous agreements, including previous versions of the Terms of Use.
